Terms of Service

These Terms of Service ("Terms") govern your access to and use of the WiseDay Concierge platform, including the interactive map, business directory, digital real estate marketplace, outreach tools, and all related services (collectively, the "Service"). The Service is operated by WiseDay Concierge ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility & Accounts

You must be at least 13 years old to use the Service. If you are acting on behalf of a business, you represent that you have the authority to bind that business to these Terms. You are responsible for maintaining the security of your account credentials and for all activity under your account.

2. Business Listings & Storefronts

The Service includes a directory of business profiles. Some profiles are seeded from public information and remain unclaimed ("placeholders"); others are claimed and managed by their owners. If you claim a business profile, you affirm that you are the owner or authorized representative. You are responsible for the accuracy of the information you publish on your storefront, including hours, contact details, offers, and images.

We reserve the right to suspend or remove listings that contain false, misleading, or prohibited content, or that violate these Terms or our Acceptable Use Policy.

3. Digital Real Estate & Marketplace

The Service allows users to purchase, lease, and resell digital parcels on the map. A digital parcel is a non-physical, non-transferable license to display content in a designated area of the Service. Ownership of a parcel does not convey any real-world property rights, title, or interest in physical land.

Parcel purchases are processed through Stripe. By purchasing a parcel, you agree to the pricing displayed at checkout. Parcels may be resold or leased through the Service's marketplace features, subject to our platform fees.

4. Subscriptions & Payments

Certain features require paid subscriptions (e.g., WiseDay Pro Search, Business Pro Bundle, City Leaderboard Insights, Business Pro AI Advisor) or one-time purchases (e.g., Featured Boost, Animated Map Marker). Subscription fees are billed monthly through Stripe until cancelled. You may cancel a subscription at any time; access continues until the end of the current billing period. One-time purchases are non-recurring.

Refunds are governed by our Refund & Dispute Policy. By making a purchase, you agree to the applicable pricing and our Refund & Dispute Policy.

5. Owner Outreach & Communications

The Service may send outreach emails to unclaimed business profiles inviting owners to claim their listings. If you receive such an email and are not the business owner, please disregard it and contact us to have your information removed. By claiming a profile, you consent to receiving service-related emails, including notifications, reports, and re-engagement messages.

6. User Content

You retain ownership of content you submit to the Service (e.g., logos, photos, descriptions, reviews). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute that content within the Service. You represent that you have the rights to all content you submit and that it does not infringe any third-party rights.

7. Prohibited Conduct

You agree not to misuse the Service. Prohibited conduct is detailed in our Acceptable Use Policy. Violations may result in account suspension or termination without refund.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that business information (including addresses, hours, or contact details) is accurate, current, or complete. Verified address indicators reflect our good-faith verification process but are not a guarantee of correctness.

9. Limitation of Liability

To the maximum extent permitted by law, WiseDay Concierge shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may close your account at any time. Upon termination, your access to the Service ceases, though your published storefront content may remain visible until removed.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
